The Faculty of Law at the University of Karbala discussed the doctoral thesis tagged: “The Legal Regulation of the Contract for Employment of Foreign Workers – A Comparative Study”. The thesis was submitted by the student “Ahmed Zaki Yahya”.
The thesis aimed to show the importance of human resources, which means highly skilled and qualified workers that countries may lack. The rise of economic reality is the ultimate goal of many countries which is manifested through the empowerment of human and natural resources. This, therefore, entails the necessity of bringing in foreign expertise, which has recently witnessed a huge change in the recruitment of expatriate workers and the start of private companies to bring them from their countries.
The thesis concluded that bringing in foreign expertise is done through a written employment agreement. However, this agreement carries many major problems both legally, in terms of access to all the legal rules governing the work of this category and which, most of the time, are limited to procedural issues, without the relevant substantive rules, and specifically the multiplicity of ways to use them whether Directly or indirectly through the official offices that deal with the parties to the agreement or through the offer of services.
In conclusion, the researcher reached a number of proposals, the most important of which is the Iraqi legislator’s call for the necessity of regulating the recruitment of foreign labor by a special law that balances the interest of foreign labor and local labor without harming the national economy.
